These Terms of Use (“Terms”) apply to your use of OpenAI API requests from natural persons, together with any associated software applications, technologies and websites (“Services”), including personal use and non-commercial use of our Services by consumers. You enter into a contract with us by confirming your acceptance of these Terms or by using the Services.
Our Business Terms govern your use of ChatGPT Enterprise, our APIs, and our other services for businesses and developers.

Registration and Access
Minimum age. You must be at least 18 years old or the minimum age required in your country to consent to use the Services. If you are under 18 years of age, you must obtain your parent’s or legal guardian’s permission to use the Services and ask them to read these Terms with you.
Requests
You must provide us with true, accurate and complete information to make a request and obtain our services. You must not share anything available to third parties, and you will be responsible for all activities that occur on your requests. If you create a request or use the Services on behalf of another person or entity, you must be authorized to accept these terms on behalf of such person or entity.
Use of Our Services
Permitted Actions. You may access and use our Services subject to your compliance with these Terms. When using our Services, you must comply with all applicable laws, as well as the specific terms and policies applicable to the Services listed above.
Actions Not Allowed
You may not use our Services for any illegal, harmful or abusive activities.
For example, it is prohibited:
Use our Services in a manner that infringes, violates or misappropriates the rights of any person.
Attempt or assist anyone in reverse engineering, decompiling or discovering the source code or underlying components of our Services, including our models, algorithms or systems (unless this restriction is prohibited by applicable law).
Automatic or programmatic extraction of data or Output (as that term is defined below).
State that the Output has been generated by humans when this has not been the case.
Disrupt or interfere with our Services.
Use Output to develop competing models.
Feedback.
We welcome feedback regarding our Services, but you agree that we may use it to provide, maintain, develop and improve our services without compensation.
Content
Our Intellectual Property Rights
We and our related entities own all right, title and interest in and to the Services. You may only use our name and logo upon express request and approval.
Fees: All charges, including application fees, will be clearly explained to you prior to purchase.
Billing. If you purchase a request, you must provide us with your complete and accurate billing information, including a valid payment method.
Order cancellation. You will not have the right to cancel your purchase and request a refund as it is a custom-ordered product.
Changes. We may change our prices at any time.
External requests. If for any reason beyond our control our requests to our intermediation API with OPENAI are cancelled, we will be forced to cancel the service provided with the return of the payment made in advance.
Result of the requests. Our requests to our intermediation API with OPENAI return customized results based on the request made, with the payment and information for said request being recorded. The results are independent of us, we are only carriers of the information requested and that obtained by the other AI source. Nothing can be claimed for the results obtained. If you want other results, you must make another request with the relevant modifications to your request. In case it was due to an error of results in poor condition, illegible, we will request a review from OPENAI to request the correct results again.
Resources. If you consider that we have not processed your request correctly or there has been an error, you can appeal our decision by contacting our Support service.
Our Commitments
We undertake to provide you with the Services and to act with due diligence and professionalism. We do not guarantee that the Services will be available in perpetuity or that they will be available in their current form for any period of time.
Responsibility. Provided we have acted with professional diligence, we accept no liability for any loss or damage caused by us other than loss or damage: caused by our failure to comply with these Conditions or which were reasonably foreseeable upon acceptance. these Conditions. We will not be liable for any loss or damage that may arise from events over which we have no reasonable control. We do not exclude or limit our liability to you in any case where it would be unlawful to do so. You will continue to enjoy the full protection of the laws that apply to you. We are not responsible for the results provided by the AI, conceptual errors, grammatical errors, syntax errors, or language errors must be reviewed and corrected by the end user or client. The results are approximate and of a novel technology yet to mature in constant evolution.
Irrevocable Rights. You have certain non-waivable rights that cannot be limited or excluded under a contract such as these Conditions, or that legally assist you, for example, as a consumer. These Conditions are not intended to limit or restrict such rights.
Guarantee for EEA Consumers. If you are a consumer resident in the EEA, EEA consumer laws provide you with a legal guarantee covering the Services. If you have any questions about this legal guarantee, please contact our Support service.
Dispute resolution
Concerns. In the event of a dispute, we would like to be able to understand and try to resolve your concerns before resorting to court. To share your concerns you can contact us.
Judicial route. If we are unable to resolve the dispute, either you or we may resort to the local courts of Granada, Spain.
Alternative Resolution of Consumer Disputes in the EEA. If you are resident in the EEA, you can also submit your dispute to an alternative dispute resolution body through the European Commission’s Online Dispute Resolution (ODR) Platform, which can be accessed through this link: https ://ec.europa.eu/consumers/odr.
Copyright Claims
If you believe that your intellectual property rights have been violated, please send a notification to the email address. We will submit direct claim on your behalf.
Any written claim of copyright infringement must include the following:
The electronic or physical signature of the person authorized to act on behalf of the copyright owner;
A description of the copyrighted work that you claim has been infringed;
A description of where the allegedly infringing material is located on our website so that we can locate it;
Your address, telephone number and email address;
A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
A statement signed by you that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Modification of these Conditions or Our Services. We are constantly working to develop and improve our Services. Accordingly, we may update these Terms or our Services from time to time. For example, we may modify these Terms or the Services due to:
Legislative or regulatory changes.
Security or protection reasons.
Circumstances beyond our reasonable control.
The introduction of changes in the ordinary development of our Services.
The need to adapt to new technologies.
Commercial Controls. You must comply with all applicable trade laws.
Applicable Law. These Terms will be governed by the laws of the jurisdiction in which you reside.
Addendum on Business Use of the Services
Commercial and Business Use. If you use our Services for commercial or business use, the following conditions apply. In the event of a conflict between this Addendum on Business Use of the Services and the rest of these Terms, this Addendum shall prevail.
Limitation of Liability. NEITHER WE NOR ANY OF OUR RELATED ENTITIES OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED ERDITS OF THE POSSIBILITY OF SUCH DAMAGES.
